Onuigbo Vs Atuma: Court Gives Date To Deliver Judgement


A Federal High Court sitting in Umuahia, Abia State has reserved Tuesday, 4th October 2022 for judgment on the case filed by the member representing Ikwuano/ Umuahia Federal Constituency, Chief Sam Onuigbo against the All Progressive Congress APC, INEC and Chief Emeka Atuma.

Chief Onuigbo had approached the court seeking to be legally recognized as the duly elected candidate for APC Abia Central senatorial district in the party primary election for 2023 National Assembly election.

He is also challenging the party for replacing his name with Chief Emeka Atuma who he said contested for APC governorship primaries and not senatorial seat.

Answering questions from newsmen shortly after the sitting, Counsel for Sam Onuigbo, Emeka Obegolu, SAN said the court took the preliminary objections of the first and third respondents challenging the jurisdiction of the court and thereafter took the original summons and adjourned for judgment on Tuesday next week.

Obegolu had argued that INEC duly monitored the APC senatorial election held on 28th and 29th of May 2022, adding that the respondents have not disputed INEC’s report that the primary election was held on 28th May this year through indirect primaries.

He had also told the court that there was no prove that Emeka Atuma paid for senatorial form.

Also, the APC counsel, Professor Sam Erugo SAN in his submission said that Sam Onuigbo did not participate in the indirect primaries which produced Chief Emeka Atuma in a later date and prayed that the court should reject question two and number two of the preliminary objections filed by Obegolu.

He also prayed the court the strike out the matter.

After listening to the counsels, the presiding judge, Justice Evelyn Anyadike reserved judgment on the jurisdiction of the case to Tuesday next week 4th October, 2022.

Recall that Onuigbo had approached the Court to uphold the APC Abia Central Senatorial primary election which was conducted on May 28 producing him as winner.
